I am surprised that others you spoke to were not aware of this issue. It is one of what I consider to be most important issues regarding legislation impacting HOAs in the last year. It is unknown at this point what the impact will be, however, there is a strong reason to be concerned that this language may remove the shield directors have on certain types of claims even if they have purchased insurance.

Your commentary on AB 1233 regarding director liability on uninsured claims was very interesting. As an HOA board president I contacted our reputable and experienced insurance broker who knew nothing of this legislation. He followed up with two HOA attorneys, prop mgrs, other insurance brokers and others who are in the know. However, they all knew nothing about this legislation and said they "are not concerned that it has increased the exposure for volunteer board members." Are you blowing smoke? Is there some infinitesimal risk of something that would likely never happen in the real world?
